Copyright and DMCA Policy

Cubby respects the intellectual property of professors, schools, publishers, and everyone else. Students upload their own course materials to Cubby, and those uploads stay private to the student's account. If you believe material on Cubby infringes your copyright, or you want materials you own removed, contact our designated copyright agent.

Professors and schools

If you are a professor or a school and believe a student uploaded your syllabus, slides, exams, model answers, or other materials without permission, email the agent above. Include the course, the school, and the materials you want removed. We review every request and remove material that a student did not have the authority to upload.

Filing a copyright notice

Under the Digital Millennium Copyright Act (17 U.S.C. § 512), a notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material claimed to be infringing, with enough detail for us to locate it, such as the course, school, file name, or the account that uploaded it.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Counter-notice

If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to the agent above. It must include your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, your name, address, and telephone number, and your consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district in which Cubby may be found), and to accept service of process from the person who filed the original notice.

Repeat infringers

Cubby terminates, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.
